These Terms of Service ("Terms") apply to your use of the enemyscalez.com website (the "Site") and form the basis of any inquiry you make to EnemyScalez Agency, LLC ("EnemyScalez," "we," "us"), a growth marketing agency based in Texas. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
What we do
We provide marketing services including Meta (Facebook and Instagram) advertising, website builds, CRM and automation setup, and email and SMS marketing. The Site describes those services in general terms. Nothing on the Site is a binding offer.
Working with us
Submitting a quote request, newsletter sign-up, or brand application does not create a client relationship. A client engagement begins only when both parties agree to a written proposal, contract, or statement of work that sets out the scope, fees, payment terms, and timeline. If anything in that written agreement conflicts with these Terms, the written agreement controls for that engagement.
No guarantees of results
Advertising and marketing results depend on many factors outside our control, including your offer, pricing, market, competition, ad platform policies, budget, and how quickly leads or orders are handled. Any results, figures, or examples shown on the Site describe specific past engagements and are not a promise or guarantee that you will achieve the same or similar results.
Client responsibilities and third-party platforms
If we work together, you're responsible for the accuracy of the information, assets, and access you give us, and for having the rights to use them (including logos, product photos, and customer data). Our services run on third-party platforms such as Meta, Google, Shopify, Klaviyo, and others. Those platforms set their own rules and can change them, restrict accounts, or reject ads at their discretion, and we aren't responsible for their decisions. You're also responsible for complying with the laws that apply to your business and offers, including advertising, email, and text-message consent requirements, unless our written agreement says otherwise.
Intellectual property
The Site, including its text, design, graphics, and code, belongs to EnemyScalez Agency, LLC or its licensors and is protected by applicable law. You may view it and share links to it, but you may not copy, reproduce, or resell it without our written permission. Ownership of work we create for a client is governed by that client's written agreement. We may describe the work we've done for clients, including client names and logos, as examples of our work, unless the client has asked us in writing not to.
Acceptable use
Don't use the Site to break the law, interfere with its operation, attempt to gain unauthorized access to it or our systems, submit false or misleading information, or send spam through our forms.
Client portal and logins
If you receive a login to our client portal or dashboard, you're responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you think your login has been compromised.
Third-party links
The Site may link to third-party websites and services. We don't control them and aren't responsible for their content or practices.
Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, EnemyScalez Agency, LLC and its members and team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of your use of the Site. For any client engagement, our liability is limited as set out in the written agreement for that engagement.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from them will be handled in the state or federal courts located in Texas, and you consent to that venue.

How we handle information you send us is described in our Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the date at the top of this page. Continuing to use the Site after a change means you accept the updated Terms.
